Welcome to AppSpeaker.io ("Service", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our AI-powered review management platform. By creating an account or using our Service, you agree to be bound by these Terms.

1. Description of Service

AppSpeaker.io is an AI-powered Software-as-a-Service (SaaS) platform that helps mobile app developers manage and respond to app reviews on Google Play Store and Apple App Store. Our Service:

• Fetches reviews from your connected app store developer accounts via OAuth
• Uses artificial intelligence (AI) to generate response suggestions to reviews
• Provides an optional Autopilot feature that can automatically send AI-generated responses
• Offers analytics, sentiment analysis, and insights about your reviews
• Allows you to create custom instructions to guide AI response generation

2. Account Requirements

To use AppSpeaker.io, you must:

• Be at least 18 years old. This Service is not intended for users under 18.
• Have a valid Google Play Developer account and/or Apple App Store Connect account
• Authorize our application to access your reviews via OAuth (Google OAuth 2.0 or Apple Sign-In)
• Provide accurate and complete account information
• Maintain the security of your account credentials
• Only connect applications that you legally own or have authorization to manage

You are responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

2.1 Consent to Marketing Communications

By creating an account, you consent to receive marketing and promotional communications from AppSpeaker.io, including:

• Product updates, new features, and service announcements
• Promotional offers, discounts, and special deals
• Tips, best practices, and educational content
• Newsletters and industry insights
• Surveys and feedback requests

You may opt out of marketing communications at any time by clicking the "unsubscribe" link in any email or by contacting us. Opting out of marketing does not affect essential service communications.

3. Subscription Plans and Billing

3.1 Subscription Tiers

AppSpeaker.io offers multiple subscription tiers (Free, Pro, Business, and Enterprise) with varying features, limits, and pricing. Current pricing and features are displayed on our website and within the application.

3.2 Billing

• Paid subscriptions are billed in advance on a monthly or annual basis
• All payments are processed securely through Stripe. We do not store your credit card information.
• Subscription fees are non-refundable except as required by applicable law
• Annual subscriptions may offer discounted pricing

3.3 Response Quotas

• Each subscription tier includes a monthly quota of AI-generated responses
• Unused responses do not roll over to the next billing period and will expire
• Additional responses cannot be purchased separately

3.4 Price Changes

We reserve the right to modify our pricing at any time. We will provide at least 30 days' notice before any price changes take effect for existing subscribers. Continued use of the Service after price changes constitutes acceptance of the new pricing.

3.5 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us. Upon cancellation:

• You will retain access until the end of your current billing period
• No refunds will be issued for unused time
• Your account will be downgraded to the Free tier (if available) or deactivated

4. AI-Generated Content Disclaimer

4.1 Nature of AI-Generated Content

You acknowledge and agree that:

• AI-generated responses are suggestions only, not professional advice
• AI may generate content that is factually incorrect, contextually inappropriate, or potentially offensive
• AI responses are based on patterns in training data and may not reflect your brand voice perfectly
• The quality and appropriateness of AI responses cannot be guaranteed
• AI may misinterpret review context, sentiment, or intent

4.2 Your Responsibility

You are solely and entirely responsible for:

• Reviewing all AI-generated content before publication
• Editing responses as necessary to ensure accuracy and appropriateness
• Ensuring all published responses comply with Google Play policies, Apple App Store guidelines, and applicable laws
• Any consequences arising from responses published through our Service
• Any damage to your app's reputation, ratings, or user relationships resulting from published responses

4.3 No Liability for AI Content

AppSpeaker.io expressly disclaims all liability for AI-generated content. We are not responsible for:

• The accuracy, completeness, or appropriateness of AI-generated responses
• Any business losses, reputation damage, or user complaints resulting from published responses
• Violations of app store policies caused by AI-generated content
• Any legal claims arising from content published through our Service

5. Autopilot Feature

5.1 How Autopilot Works

The Autopilot feature (available on certain subscription tiers) can automatically:

• Generate AI responses to new reviews based on your custom instructions
• Publish responses directly to app stores without manual approval
• Process reviews according to rules and filters you configure

5.2 Autopilot Risks and Responsibilities

By enabling Autopilot, you acknowledge and accept that:

• Responses will be published without your review before sending
• AI may generate inappropriate, incorrect, or harmful responses that are automatically published
• You are solely responsible for all content published via Autopilot
• You must configure appropriate custom instructions and filters
• AppSpeaker.io bears no responsibility for any consequences of Autopilot-published responses
• You should regularly monitor Autopilot activity and adjust settings as needed

5.3 Custom Instructions

You may create custom instructions to guide AI response generation. You are responsible for ensuring your custom instructions:

• Are clear and appropriate
• Do not instruct the AI to generate harmful, illegal, or policy-violating content
• Reflect your actual brand voice and policies

6. User Responsibilities and Acceptable Use

6.1 Your Responsibilities

When using AppSpeaker.io, you agree to:

• Use the Service only for lawful purposes
• Comply with all applicable laws and regulations
• Comply with Google Play Developer policies and Apple App Store Review Guidelines
• Not use the Service to send spam, harassment, or abusive content
• Review AI-generated content before publishing (unless using Autopilot at your own risk)
• Maintain appropriate professional standards in all published responses

6.2 Prohibited Uses

You may not use our Service to:

• Manage applications that violate app store policies or applicable laws
• Generate or publish illegal, defamatory, harassing, or threatening content
• Impersonate others or misrepresent your identity
• Manipulate reviews or ratings fraudulently
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Reverse engineer, decompile, or disassemble the Service
• Use the Service for any application involving illegal gambling, adult content, or other prohibited categories
• Resell or redistribute the Service without authorization

7. Service Availability

7.1 No Service Level Agreement (SLA)

AppSpeaker.io is provided on an "as available" basis. We do not guarantee any specific uptime or availability. The Service may be unavailable due to:

• Scheduled or unscheduled maintenance
• Technical issues or outages
• Third-party service disruptions (Google, Apple, AI providers)
• Force majeure events

7.2 Maintenance and Updates

We reserve the right to:

• Perform maintenance at any time, with or without notice
• Modify, update, or discontinue features
• Temporarily suspend the Service for technical reasons

We will make reasonable efforts to minimize disruption but are not liable for any downtime or service interruptions.

8. Data and Backups

8.1 Your Data

You retain ownership of your data, including your review responses and custom instructions. By using the Service, you grant us a license to process your data as necessary to provide the Service.

8.2 No Backup Guarantee

AppSpeaker.io is not liable for any data loss, corruption, or inability to recover data for any reason.

9. Intellectual Property

9.1 Our Intellectual Property

AppSpeaker.io and its licensors retain all rights to:

• The Service software, code, and infrastructure
• Our branding, logos, and trademarks
• AI models and algorithms (provided by third-party providers)
• Documentation and support materials

9.2 Your Content

You retain ownership of:

• Your custom instructions and configurations
• Responses you create or edit
• Your app data and review history

10. Limitation of Liability

10.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF AI-GENERATED CONTENT
• UNINTERRUPTED OR ERROR-FREE OPERATION

10.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APPSPEAKER.IO SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damage to reputation or goodwill
• Cost of substitute services
• Any damages arising from AI-generated content
• Any damages arising from Autopilot feature usage
• Any damages arising from service interruptions or data loss

10.3 Maximum Liability Cap

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. For Free tier users, our maximum liability is zero (0) EUR.

10.4 Essential Purpose

These limitations apply even if any remedy fails of its essential purpose and regardless of the theory of liability (contract, tort, strict liability, or otherwise).

11. Indemnification

You agree to indemnify, defend, and hold harmless AppSpeaker.io, its owner, affiliates, and service providers from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:

• Your use of the Service
• Content published through your account (including AI-generated and Autopilot content)
• Your violation of these Terms
• Your violation of any third-party rights or applicable laws
• Your violation of app store policies

12. Termination

12.1 Termination by You

You may terminate your account at any time by canceling your subscription and deleting your account through the settings, or by contacting us.

12.2 Termination by Us

We may suspend or terminate your account immediately, without notice, if you:

• Violate these Terms of Service
• Engage in fraudulent, illegal, or abusive activity
• Fail to pay subscription fees
• Use the Service in a way that harms us or other users
• Are required to be terminated by law or third-party providers

12.3 Effect of Termination

Upon termination:

• Your access to the Service will be immediately revoked
• We may delete your data in accordance with our Privacy Policy
• No refunds will be issued
• Sections regarding limitation of liability, indemnification, and governing law survive termination

13. Third-Party Services

Our Service integrates with third-party services including:

• Google Play Developer API - for fetching and responding to Android app reviews
• Apple App Store Connect API - for fetching and responding to iOS app reviews
• Google AI (Gemini) - for AI response generation
• Stripe - for payment processing

These services are governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, or policies of third-party services.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Posting the updated Terms on our website
• Updating the "Last updated" date
• Sending an email notification for significant changes

Continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service and cancel your subscription.

15. Governing Law and Disputes

These Terms are governed by the laws of Poland, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved in the courts of Poland. You agree to submit to the personal jurisdiction of such courts.

For EU consumers: You may also have rights under the consumer protection laws of your country of residence.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AppSpeaker.io regarding the Service.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms without our consent. We may assign our rights and obligations without restriction.

16.5 Language

These Terms are provided in English. In case of any discrepancy between translations, the English version prevails.
